FAQ’s

Will I have to go to court?

Not necessarily. Most cases are settled often before a lawsuit is filed and if your case results in litigation, your case may settle before or even during trial.

Why does The Elmore Law Firm so frequently win favorable settlements?

We always deal from strength, never from weakness. We fully prepare the case to go to trial, hire the proper experts, do the proper investigation, research important legal issues of the case and take depositions of important witnesses.

The defendant and the defendant's insurance company know of our years of experience and successful track record.

Of course, there is no guarantee that the most well-prepared, solid cases will end in settlement before reaching trial.

Can I afford your services - what are your fees?

If the case is investigated and found to be meritorious, we will inform you what we believe to be a reasonable contingency fee.

If I have been referred to you by another lawyer, does that mean my case is going to cost me more money?

Absolutely not. Many of our clients are referred to us by other lawyers and any fee will be divided between the firms and your total fee will be the same as if only one firm was involved. You will not be required to pay any additional money.

Why don't my lawyers handle these cases themselves?

In today's world of specialization, it is difficult, if not impossible, for lawyers to keep up on all areas of the law. In particular, medical malpractice and nursing home abuse cases require the assistance of expert witnesses. Complex personal injury and wrongful death cases may also require experts such as accident reconstructionists, life care planners and economists who can explain to the jury the value of a lifetime of lost wages and future medical care. We at the Elmore Law Firm have relationships with qualified experts. Also, if you live outside of North Carolina but were injured in our state, your local attorney may not be licensed to practice law here.

How long will this process take?

There is no clear answer. Many defendants and insurance companies drag their feet and delay the conclusion of the case. Please understand that because our fee is contingent, The Elmore Law Firm does not get paid until you do. Thus, there is clear incentive on our behalf to push your case for an early successful conclusion.

Who will work on my case?

The Elmore Law Firm accepts only a small number of cases. Therefore, virtually everyone in the office works on some aspect of each case. We have developed a "trial team" approach and meet often as a team to plan strategy. Your case would be worked on by the trial lawyer, a paralegal, and technical specialists within the firm. We call it team work. In many cases we also include independent experts such as doctors, nurses, hospital administrators, private investigators, accident reconstructionists, vocational rehabilitation experts, life care planners and economists.

Will you take my case?

We can only accept meritorious cases. Sometimes the question of whether a case is meritorious can be answered immediately. In other instances, particularly with medical malpractice and nursing home cases, the law firm needs additional time, effort, and investigation to establish if a case has merit. If you have been seriously injured, we will use all of our resources to help you. If we are not able to accept employment in your case, we will notify you immediately and encourage you to obtain a second opinion. Because of the small number of cases we accept, we develop strong personal relationships with our clients.
